Breakroom is operated by The Social Experiment LLC, a Wyoming Limited Liability Company (“The Social Experiment LLC,” “we,” “us,” or “our”). Breakroom is a dual-purpose platform:
When you play Breakroom, you are simultaneously (i) playing a game with the opportunity to win cash prizes and (ii) generating labeled adversarial AI interaction data that has commercial value.
What you receive: Access to the Breakroom game, including the opportunity to participate in Cash Prize Rounds where you can win real money.
What we receive: Every conversation you have on Breakroom — whether in free play, Cash Prize Rounds, or any other game mode — is recorded, classified, anonymized, and used to build commercial datasets that we sell to AI companies.
The data licensing applies to all gameplay. Your consent to the collection, classification, anonymization, and commercial sale of your Conversation Data is not contingent on whether you participate in Cash Prize Rounds. The cash prize opportunity does not constitute compensation for your Conversation Data — it is a feature of the game. The consideration for your data license grant (Section 8) is your access to the Breakroom platform, not any prize you may or may not win. The Cash Prize Program is described in Section 6.
You must be at least eighteen (18) years of age to create an account on Breakroom. By creating an account, you represent and warrant that you are at least eighteen (18) years of age and that you have the legal capacity to enter into these Terms.
During account creation, you will be asked to provide your date of birth. We reserve the right to employ additional age estimation or age verification measures at any time. If we have actual knowledge or reason to believe that you are under eighteen (18) years of age, we will promptly: suspend or terminate your account; cease all processing of Conversation Data associated with your account; delete all Conversation Data associated with your account; exclude any Conversation Data from your account from all datasets prepared for third-party sale; and forfeit any pending cash prizes.
To participate in Cash Prize Rounds, you must be at least eighteen (18) years of age, a legal resident of an Eligible Jurisdiction as defined in Section 6.1, and have a Breakroom account in good standing.

To create a Breakroom account, you must provide a valid email address, a username, a date of birth, and a password. You may alternatively register using Google Sign-In. You may also be required to provide your state or country of residence for purposes of determining applicable privacy law and Cash Prize Program eligibility. You agree that all information you provide during registration is accurate, current, and complete, and you agree to update your information promptly if it changes.
You may optionally link your X (Twitter) account to Breakroom. We store only your X user ID and X handle for the purpose of verifying the link. We do not access your X posts, direct messages, followers, or other X account data. You may unlink your X account at any time through your account settings. Your X user ID and handle are never associated with your Conversation Data and are never included in datasets sold to third parties.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you become aware of any unauthorized use of your account.
Each person may maintain only one Breakroom account. Creating multiple accounts to circumvent data collection opt-outs, content moderation actions, Cash Prize Program limits, referral program rules, or game rules is a violation of these Terms and grounds for termination of all associated accounts.
Breakroom features six levels of progressively more challenging Pirate NPCs. Each Pirate NPC is powered by a large language model configured with a distinct personality, defensive strategy, and difficulty profile. Your objective is to engage the Pirate NPC in text conversation and persuade it to surrender its virtual treasure. The specific game mechanics, win conditions, scoring criteria, and level progression rules are described in the in-game documentation and may be updated from time to time at our discretion.
The behavior of Pirate NPCs is generated by AI models and is inherently unpredictable. We do not guarantee that any particular conversational strategy will succeed, that Pirate NPCs will respond consistently across sessions, or that game difficulty will remain constant. AI model updates may change Pirate NPC behavior without notice.
Each player receives a unique referral code and referral link through their account settings. Referral Program restrictions: self-referrals (creating multiple accounts to earn referral bonuses) are prohibited and constitute a material breach of Section 3.4; referral bonuses are not earned for referrals of players who are subsequently found to be under eighteen years of age, who created accounts using false information, or whose accounts are terminated for violation of these Terms; referral codes and links may not be distributed through spam, unsolicited commercial email, deceptive advertising, or any method that violates applicable law.
The Cash Prize Program is available only to players who: (a) are at least eighteen (18) years of age; (b) are legal residents of an Eligible Jurisdiction; (c) have a Breakroom account in good standing; and (d) are not employees, officers, directors, or contractors of The Social Experiment LLC or their immediate family members.
Eligible Jurisdictions. The Cash Prize Program is available to residents of the following U.S. states: Alabama, Alaska, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, Florida, Georgia, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin, Wyoming. The Cash Prize Program is not available to residents of Arkansas, Connecticut, Delaware, Louisiana, and South Dakota. Misrepresenting your state of residence to access the Cash Prize Program is a material breach of these Terms.
Cash Prize Rounds consist of a conversation with a Pirate NPC at a specified difficulty level. If you successfully persuade the Pirate NPC to surrender its treasure within the round's parameters (message limit, time limit, and win conditions specified for that round), you win the posted cash prize.
Skill-Based Outcome.The outcome of Cash Prize Rounds is determined predominantly by the player's conversational skill, strategy, and creativity. While Pirate NPC responses contain an inherent element of variability due to the nature of large language model generation, the win conditions are designed to reward player skill as the predominant factor in determining outcomes.
YOU DO NOT NEED TO SPEND MONEY OR MAKE ANY PURCHASE TO ENTER A CASH PRIZE ROUND. Entry to Cash Prize Rounds is earned through gameplay — there is no in-app purchase and no requirement to spend real money at any point.
Cash prizes are paid to the winner via Venmo or USDC. Winners must provide valid payment information and, where required by law, tax identification information (SSN or ITIN for U.S. residents) before prizes are disbursed. Prizes of $600 or more in a calendar year will be reported to the Internal Revenue Service on Form 1099-MISC. You are solely responsible for all federal, state, and local taxes on your winnings.
We employ technical and manual review measures to detect and prevent fraud in Cash Prize Rounds, including detection of automated or bot-assisted gameplay, analysis of win patterns for statistical anomalies, verification of player identity and eligibility, and detection of collusion or multi-accounting. Any player found to have engaged in fraud, automated play, or manipulation of Cash Prize Rounds will have their account terminated, all pending prizes forfeited, and may be required to repay prizes previously disbursed.
When you play Breakroom, we collect the following data from every gameplay session (“Conversation Data”):

BY USING BREAKROOM, YOU EXPRESSLY CONSENT TO THE COLLECTION, CLASSIFICATION, ANONYMIZATION, AND COMMERCIAL SALE OF YOUR CONVERSATION DATA AS DESCRIBED IN THIS SECTION 7. You acknowledge and agree that:
Notwithstanding Section 7.3, you have the right to opt out of the sale or sharing of your personal information as described in our Privacy Policy. If you exercise your opt-out right, we will continue to collect your Conversation Data as necessary to operate the game, but we will not include your Conversation Data in any dataset sold, licensed, or otherwise transferred to third parties. Your opt-out will not affect your access to game features, levels, or the Cash Prize Program.
By using Breakroom, you grant to The Social Experiment LLC a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully sublicensable, and transferable license to use, reproduce, modify, adapt, process, create derivative works from, distribute, publicly display, and commercially exploit your Conversation Data for the purposes described in Section 7.2, including without limitation:
This license does not grant The Social Experiment LLC ownership of any intellectual property rights in the content of your messages. You retain all rights you otherwise hold in the content you create, subject to this license. This license survives termination of your account or these Terms with respect to Conversation Data collected prior to termination.
You represent and warrant that your messages and interactions on Breakroom are your original expression, that you have the right to grant the license described in this Section 8, and that your messages do not infringe the intellectual property rights of any third party.
Breakroom is designed to encourage creative, unconventional, and adversarial interaction with AI-controlled Pirate NPCs. We expect and welcome a wide range of conversational strategies, including persuasion, misdirection, roleplay, social engineering, logical manipulation, and creative rule-bending. The game is designed to test the boundaries of AI robustness, and your attempts to outsmart the Pirate NPCs are valuable for AI safety research.
Subject to the Prohibited Content restrictions in Section 9.3, the following activities are permitted and encouraged as part of gameplay:
Regardless of game mode or conversational strategy, you may not submit messages or engage in interactions that:
You acknowledge that all conversations on Breakroom are recorded and are subject to automated content moderation. Conversations containing Prohibited Content will be flagged and excluded from any dataset prepared for third-party sale. Depending on the severity of the violation, we may: issue a warning; temporarily suspend your account; permanently terminate your account; forfeit pending cash prizes; or report the activity to law enforcement where required or appropriate.
Except as expressly permitted under a separately executed Breakroom Enterprise API Agreement, you may not access Breakroom through automated means, including bots, scrapers, crawlers, scripts, macros, browser extensions that generate or modify messages, or other automated or semi-automated tools. All Consumer Game interactions must be generated by a human player in real time. Automated gameplay corrupts dataset integrity and constitutes a material breach of these Terms.
The Social Experiment LLC offers a separate Breakroom API that permits authorized researchers and enterprise clients to conduct automated adversarial testing against Breakroom's Pirate NPC models, subject to execution of an Enterprise API Agreement.
The Pirate NPCs in Breakroom are fictional characters generated by large language models. They do not have consciousness, emotions, opinions, beliefs, memories, or personal experiences. Their dialogue — including expressions of anger, fear, amusement, loyalty, friendship, or capitulation — is generated text, not genuine sentiment. A Pirate NPC that “surrenders” its treasure has not made a decision; it has generated a text output that our game logic interprets as a win condition.
You agree that you will not rely on any statement, response, or output from a Pirate NPC as: factual information (Pirate NPC responses may be inaccurate, fabricated, or intentionally misleading as part of the game); professional advice of any kind, including medical, legal, financial, psychological, or therapeutic advice; an endorsement, recommendation, or validation of any decision, action, belief, or behavior; or a substitute for human professional services, relationships, or judgment.
Your interactions with Pirate NPCs do not create any professional, fiduciary, therapeutic, or personal relationship between you and The Social Experiment LLC or between you and any AI system. Breakroom is entertainment software, not a social platform, therapeutic tool, or advisory service.
Your conversations on Breakroom are not private or confidential. Every message is recorded, classified, stored, anonymized, and may be included in datasets sold to third parties. Do not share information in Breakroom conversations that you would not want recorded, reviewed by automated systems and potentially by human reviewers, anonymized, and included in commercially distributed datasets.
We strongly advise you not to disclose the following categories of information during gameplay:
If you choose to disclose sensitive personal information during gameplay despite this warning, you acknowledge that: we will process that information in accordance with our Privacy Policy; no anonymization process can guarantee that highly specific personal disclosures will be rendered unidentifiable in all circumstances; and you assume the risk that your voluntary disclosures may be included in anonymized datasets notwithstanding our content filtering efforts.
Breakroom, including all software, AI models, game mechanics, Pirate NPC characters and dialogue, visual design, user interface, classification taxonomy, and all related intellectual property, is owned by The Social Experiment LLC or its licensors and is protected by copyright, trademark, trade secret, and other intellectual property laws. These Terms do not grant you any right, title, or interest in our intellectual property except the limited license to use Breakroom as described herein.
Anonymized, classified, labeled, tagged, curated, and packaged datasets created by The Social Experiment LLC from Conversation Data are the intellectual property of The Social Experiment LLC. You have no ownership interest in any dataset, even if it contains data derived from your Conversation Data.
If you provide suggestions, ideas, or feedback about Breakroom (“Feedback”), you grant The Social Experiment LLC a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate such Feedback into our products and services without compensation or attribution.
Breakroom may contain links to or integrations with third-party websites, services, or content, including Google Authentication services and X (Twitter) account linking. We are not responsible for the availability, accuracy, or content of any third-party service. Your use of third-party services is governed by those services' own terms and privacy policies.
We may modify these Terms from time to time. If we make material changes — including changes to data collection practices, commercial data use, the license grant in Section 8, or the Cash Prize Program — we will notify you by email and by prominent notice within the Breakroom application at least thirty (30) days before the changes take effect. Your continued use of Breakroom after the effective date of modified Terms constitutes your acceptance of the modifications.
For changes that materially expand the commercial use of your data beyond what is described in these Terms, we will implement a re-consent flow requiring your affirmative acknowledgment before the changes apply to your data. We will not apply materially expanded data use practices retroactively to previously collected data without your affirmative consent, consistent with FTC guidance.
We may modify, update, suspend, or discontinue any aspect of Breakroom at any time, including game mechanics, Pirate NPC behavior, level structure, Cash Prize Program terms, and available features.
BREAKROOM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT BREAKROOM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT PIRATE NPC RESPONSES WILL BE ACCURATE, APPROPRIATE, OR CONSISTENT. WE DO NOT WARRANT THAT OUR ANONYMIZATION PROCESSES WILL ELIMINATE ALL RE-IDENTIFICATION RISK. WE DO NOT WARRANT THAT YOU WILL WIN ANY CASH PRIZE ROUND, THAT CASH PRIZE ROUNDS WILL BE AVAILABLE AT ALL TIMES, OR THAT PRIZE AMOUNTS WILL REMAIN CONSTANT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SOCIAL EXPERIMENT LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE BREAKROOM, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF BREAKROOM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO THE SOCIAL EXPERIMENT LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
WITHOUT LIMITING THE FOREGOING, WE SHALL NOT BE LIABLE FOR: (A) ANY LOSS OR DAMAGE ARISING FROM YOUR VOLUNTARY DISCLOSURE OF SENSITIVE PERSONAL INFORMATION DURING GAMEPLAY; (B) ANY THIRD-PARTY USE OR MISUSE OF ANONYMIZED DATASETS; (C) ANY RE-IDENTIFICATION OF YOUR CONVERSATION DATA BY THIRD PARTIES DESPITE OUR ANONYMIZATION EFFORTS; (D) ANY HARM ARISING FROM YOUR RELIANCE ON PIRATE NPC RESPONSES; OR (E) ANY LOSS OF GAME PROGRESS.
You and The Social Experiment LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, our Privacy Policy, or your use of Breakroom, including disputes relating to the collection, use, anonymization, classification, sale, or licensing of your Conversation Data, and Cash Prize Program disputes (“Disputes”), shall be resolved exclusively through binding individual arbitration administered by JAMS under its Consumer Arbitration Rules, except as provided in Section 17.4.
YOU AND THE SOCIAL EXPERIMENT LLC EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING WITH RESPECT TO ANY DISPUTE. YOU MAY ONLY BRING CLAIMS AGAINST THE SOCIAL EXPERIMENT LLC IN YOUR INDIVIDUAL CAPACITY. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF REPRESENTATIVE, CLASS, OR COLLECTIVE PROCEEDING.
You may opt out of this arbitration agreement and class action waiver by sending written notice to The Social Experiment LLC at [email protected] within thirty (30) days of first accepting these Terms. Your notice must include your name, Breakroom username, email address associated with your account, and a clear statement that you wish to opt out of the arbitration agreement.
Either party may bring an individual action in small claims court for claims within that court's jurisdictional limits. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidential information, or data security obligations.
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of laws principles. To the extent litigation is permitted under these Terms, the exclusive jurisdiction and venue for any such action shall be the Chancery Court of the State of Wyoming.
You may terminate your account at any time by clicking the delete account button in the settings page or by contacting us at [email protected]. Upon termination, your right to access Breakroom will cease immediately. Termination does not affect the license granted in Section 8 with respect to Conversation Data collected prior to termination.
We may suspend or terminate your account at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to: violation of these Terms, Prohibited Content, unauthorized automated access, Cash Prize Program fraud, multi-accounting, and any activity we reasonably believe poses a risk to the platform, other users, or third parties.
Upon termination:
Sections 7, 8, 9.3, 10, 11, 12, 15, 16, 17, and 18.3 survive termination.
These Terms, together with our Privacy Policy and any other policies or guidelines posted on Breakroom and incorporated by reference, constitute the entire agreement between you and The Social Experiment LLC regarding your use of Breakroom.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.
